Effective Participation and Fitness to Plead (On Demand)

Following on from the well-received 2021 seminar Fitness to Stand Trial: A Practical Guide and offering multidisciplinary perspectives, this Om Demand will analyse the Court of Appeal’s decision in Hanara, look at issues arising as regards effective participation in the criminal justice system, and delve into practical ways in which the defendant’s interests – and therefore justice – can be better served.

The Auckland Council Diversion Policy – One Year On (On Demand)

Dog attack cases are the primary focus for the new policy, but the policy can apply to any other prosecution commenced by the Auckland Council including charges under the Resource Management Act, Building Act, or Food Act. This O Demand will offer an initial evaluation of its implementation one year on, highlighting specific scenarios where it has empowered dog owners to avoid conviction, and in minor cases of attacks, avoid the issuance of destruction orders.
