This paper will provide an update on recent case law and its implications. It will also explore managing client expectations, and practical advice addressing challenges in preparing and navigating the legal process for spousal maintenance applications including:

  • The framework of maintenance applications
  • How the Court will approach a situation where a respondent has insufficient income but access to trust or other resources
  • When interim spousal maintenance can include legal and accounting fees
  • What can be included as a party’s reasonable needs

These Materials will help you:

Recognise the implications of recent case law around Spousal Maintenance Applications.
Identify actions for preparing Spousal Maintenance Applications in complex circumstances.
