This year’s Youth Advocates Half-Day Conference provided practically focused sessions on a range of pertinent topics presented by youth justice professionals.
These Materials will focus on:
- Arrests
The ability to arrest a young person pursuant to s 214 of the Oranga Tamariki Act 1989 allows the Police to avoid the s 247(b) process and proceed straight to Court. This part of the Paper considers the preconditions to a valid arrest, other protections given by the Oranga Tamariki Act and the United Nations Convention, and effective ways to challenge the exercise of the power to arrest.
- Disclosures
Practical advice about disclosure and plea issues from a lawyer and police perspective.
- Communication Assistance
An overview of Communication Assistance and Assistants; Common Indicators of communication difficulties; and Tools that can be used by all justice stakeholders to aid communication and understanding.
- Considerations for Alleged Offending - Schedule 1A Oranga Tamariki Act 1989
17-year-old alleged offenders subject to s 272, s 275 and Schedule 1A of the Oranga Tamariki Act 1989 and implications for their youth justice journey.
- Crossover and “pushback”
This part of the Paper provides a judicial and lawyer’s perspective of the crossover between the youth justice and care and protection provisions of the Oranga Tamariki Act 1989. Including 12 and 13-year-old children who come to the attention of the police and “the pushback.”
Lawyers who would like to practise as Youth Advocates. These Materials will also be a useful refresher for those already practising in this area of law.
